New Jersey's top prosecutor leaves her post following appeals court deems ineligible her.
The ex-lawyer for the former president has stepped down as the chief federal prosecutor in the state. This decision was prompted by a legal ruling that invalidated her legal standing to occupy the role.
Acceptance of Resignation
The nation's top law enforcement official, Pam Bondi, accepted the prosecutor's departure on the start of the week. Bondi stated that the judicial decision made it "untenable" for the official to effectively run her office.
"Let no one confuse compliance for surrender," she declared. "My fight will now reach across America."
Judicial Challenge
Her resignation was triggered by a US appeals court ruled that she had been unlawfully serving as the federal prosecutor. This decision is could influence scores of prosecutions in New Jersey.
The appellate judges declared that a interim role that bypassed confirmation by the US Senate ran afoul of the Federal Vacancies Reform Act.
Ongoing Legal Battle
It was also stated that Habba will remain at the Department of Justice as a senior adviser. Habba plans to seek further review of the ruling, in the hope of achieving a reversal.
In a statement, Bondi wrote that judges "must not countermand the President's choice of lawyers tasked with performing the executive branch's core responsibility of enforcing the law."
Performance in Office
Bondi commended Habba's record and said that under her leadership, the city of Newark saw a one-fifth decrease in crime. She also stated that the Camden recorded its initial homicide-free summer since 1974 with no murders.
Connection to Donald Trump
Habba, first joined the former president's legal defense in recent years. She later acted for her client in his business records case in 2024, which resulted in his guilty verdict on dozens of charges of falsifying business records.
Before Habba took on the federal prosecutor position, the former president had revealed he was selecting her as his White House advisor if re-elected, calling Habba as deeply loyal and a "tireless advocate for justice".
